    I just went back to their site to see any updates and found this:

    Does this mean that everyone whos email is in the database could end up being put on some spam list if the database gets bought?? Im a bit confused :confused:

    I never bought from them, but i'm sure trading standards would be interested in this, i suppose it depends on what their provacy policy was. The conditions mean nothing as if thye stated they will not pass your details onto third parties then they are in breach

    I don't think its illegal - justr about everyone who has these kind of databases sell them on, even the census that we have to do is sold on, can you believe that..? sigh....

    It's not illegal. There are UK/EU laws but since Jersey is a part of Germany...errr I mean are not in either of those they can (and do) what they like.

    Even if they were in the UK they might be able to sell you information if they went with the guidelines listed at www.informationcommissioner.gov.uk

    Essentially, the information they have (including mine) is worthless IMO. If a company in Jersey started emailing you about DVDs their business would get a very bad reputation. If a UK company bought it they would be liable under numerous Data Protection Acts. I'd NEVER buy from a spammer and if everyone else takes that stance there'd be much less spam.

    To be fair, it's probably got nothing to do with Splash. When a company goes into liquidation, it is the administrator or liquidator that is responsible for selling any assets from the company to raise capital to repay debtors. I'd be surprised if there is anyone from Splash still around.

    We are writing further to your e-mail regarding the sale by tender of the client list of the liquidated company SplashDVD.

    The Data Protection Registrar has now made contact with the liquidators and has received confirmation that they will ensure all clients requesting it have their details removed from the database.     I got the same message, which is strange because I definately got loads of spam mails from them. I only ordered from them once, they cocked it up, I cancelled, never used them again. Rubbish service.

    I don't know if the liquidators have passed on the database and if so to who, but just received an email from moviechoices.com, offering a free trial of their rental service. This came through to my email account which is seldom used, but was used for a registration with Splash.

    The database got sold to BlahDVD in the end.

    Though everyone believes Blah and Splash are one and the same anyway (there's much evidence to link them).

    In my opinion it's a breach of the data protection act, and if not that, by sending emails to addresses on the list they have breached the EU and UK laws on spam (a £5k fine I believe?).

    I would also like to know where they got my e-mail address from. However, they are doing a fantastic deal on the Dirty Harry Box Set, at £17.99, less £2 if you use the spam e-mail! :rolleyes:

    I got this e-mail from blahdvd, after asking them if they were splash.

    "Hi,

    We can assure you that we are NOT and never have been associated with or connected in any way to the now defunct SplashDVD Company.

    We are a new Company set up in Jersey whose main aim is to provide excellent low cost products coupled with Good customer service to those who wish to purchase their products online.

    We can assure you that any problems you may have experienced with any other online DVD company will not be the case with us.

    Should you chose to become one of our customers you can rest easy in the knowledge that we will endeavour to satisfy all our customer's requirements and always be on hand should you have any queries.

    I suppose it could well be that they are totally pi**ed off with being associated with Splash. I have to admit, I'm slowly starting to believe them, but I still don't know where thay got my e-mail address from.

    Well, I've done it. [​IMG] Ordered the Dirty Harry Box Set for £15.99. Supposedly in stock and will be dispatched within 24 hours. I have to say, nothing in the ordering process resembled Splash, and they don't charge your card before the order is shipped. Maybe the benefit of the doubt is in order here? I'll let you all know what happens.

    I've seen their replies before but people have pointed out things like the guy sending the replies has the same name as one of the guys at Splash. The registered address is the same. Their site looks the same, the emails look the same, the deals are pretty much the same, and they have the same customer database.

    They can easily claim they have nothing to do with Splash by basically running the company under their friend's grandmother's name or something like that, and then just "happen" to employ the same people to run the company.

    I don't know for certain but the smell coming from Blah is too stinky to trust them.

    Order processing may be different if they are using a different company for that (many use a 3rd party anyway). That at least could be a good sign as perhaps 'Topper Inc' who were the ones on the statements before, went under with Splash.
