scratch on delivery but she's signed for it!!

    Yep, got my tv this morning from s&v, but the missus was in and signed that she checked the screen. Now she phones me and says there's a scratch on it!!! :eek: :eek: :eek:
    What can I do? where do I stand?

    But she`s signed for it!!!
    The responsibility lies with the courier only until the customer signs that it has been recieved in good order.

    surely it was packed when it was delivered? How are you supposed to know there is a scratch? Give them a call and tell them to come and pick it up.

    you've got 28 days to give it back, if they don't replace it, tell them it dosen't fit your needs anymore and you want your money back, i'm sure they will see sense.

    We get delivery drivers all the time at work with deliveries where the Delivery Note says "Received in Good Condition".

    Of course you don't know if it is in good condition when it is packed so this is complete nonsense. Just try telling the delivery driver to wait till you unpack the item and check it before you sign the Delivery Note. Many of them wont let you open the item until you have signed for it.

    Just call the supplier, tell them it is damaged and you need a replacement.

    If they wont replace it then tell them to take it back.

    When you sign, you are only signing that the packaging is in good order and has no visible damage.
    There is no way you can tell the condition of the unit inside.

    You are entitled to a replacement.

    I do not trust sound and vision and would never buy from them after they robbed me about 6 years ago. I`d try and get into the service menu to see how many hours this tv has clocked up. There is a chance that it may not even be brand new if it`s scratched.

    If the outer packaging is fine, then as surmised above, it sounds like an ex-display or returns.

    I think they waited until she had opened it and had a look. However she had our son in her arms and the dog running around, so I can't blame her really...

    i always sign for items and write "un-cheacked" next to name.

    Signing means nothing. Get your money back or a new one. Dont let them fob you off. Plus its defo not your missus fault. Contact your card company or trading standards and let them know they will advise you on your rights or there are a few places online that provide info to statitory rights and sog :) Whatever happens you cant lose :)

    Well all I can say is WOW!!!

    Have checked out the scratches and it must have taken me a good 15-20 secs to find them.

    There are 2 about 2 inches long slap bang in the middle of the screen, but they are so light you can't see them when a foot away.
    Will ask for a replacement but for now I'm just gonna enjoy my new th-42p70
    its such an improement over my old 28"crt :) !

    Just need to figure out my pc settings now...

    You still need to get to the service menu to see if the sold you a re-stocked tv.

    Just a point and not doubting you for a sec but have you tried cleaning the screen with a proper cleaner. It occured to me they might just be packaging scuffs if the are so light, just a thought. If they are indeed scratches your wife signing means diddely mate.

    Does anybody know how to get to the service menu on the PX70 models?

    (I have tried the "-" on TV and "i" on the remote, but this combo only takes med to the self check info screen - which btw also resets my TV!)

    I always check any delivery i get thoroughly(especially something worth around a grand in value) before i sign anything. Who`s to say the dog never jumped up and scratched the display, that`s the point, they can`t prove you did it neither can you prove they did it. They are well within their rights to say you signed recieved in good condition so we have no resposnibility there after.
    Have you contacted them yet? What was their response?

    They want me to take photos, how I'm gonna acheive a decent shot Iv'e no idea. Possibly a bit of talc in the affected area?

    We polish out scratches on perspex/plexiglas Aircraft windows in work with a kit especially for that purpose. Does the screen have a coating on it at all?? If not try polishing the scratch out if it`s not to deep. If you need a lend of the kit, if they won`t exchange your plasma, and there is no coating on the display, PM me with your details and i`ll send you my kit to borrow.

    Tell them to go fire peas at the moon (politely).

    Ask for a replacement or a refund now, be polite but insistent.

    If they wont then take the matter up with your credit card company.

    This certainly isn't what you would expect after the praise S&V has received in the forum :rolleyes:

    Yes I would contact them again & politely ask for a replacement/refund.

    According to the Sales of Goods Act the item should be free from defects. As there are scratches on the screen this is indeed a defect as they should not be there.

    If you do not get any joy from them contact your credit card company for further assistance.

    well, I emailed them back saying I couldn't get a decent photo (bit of a lie really cba) and they mailed me back saying that their couriers would be contacting me with a date for exchange!

    Very impressed. Just as long as the courier gets in contact with me...

    Make sure it will be a brand new in box unopened unit (DO NOT ACCEPT A REFURBISHED UNIT) and check it over with a fine tooth comb as i know you will.

    When i received my Panny 50" plasma two years ago the company used a middlemen as the plasma came from another country, Germany to Sweden.

    I told the driver i wanted to check it first and the delivery guy got annoyed and pretty unpleasant telling me he doesn't have time with this and it's not his responsibility if the goods are damaged so i signed it.

    One hour later i opened it and was schocked, the whole plasma screen was cracked all over.

    Called the seller in Germany and hoped for the best, the seller told me to contact the delivery company and understood he just wanted to get free from any responsibility so i told him it's not me who has to deal with this but himself should contact them and arrange it.

    Thank god the seller then said he would contact the freight company in Germany and after an hour or so he called me up and said they would pick up the damaged plasma and i would get a new one delivered the same week.

    The second plasma arrived 3 days later packed on a EURO pallet which the first didn't come on.

    I checked it and it was like new, no problems.

    What i want to say, i learned from experience and it could have been a nightmare for me if the seller haven't backed me up.

    Next time i will goto a shop and buy it and not mailorder.

    Plasmas are so fragile and only a small bump or something could make the glass shatter in the panel.

    And secondly, you should ALWAYS demand the plasma to come on a EURO pallet strapped, otherwise the delivery guys will tilt the whole box and the glass will 100% crack everywhere.

    The delivery driver that brought my PH9 from AV Sales said mine was the first he had delivered on a Pallet. I`d asked for it to be securely strapped down/delivered and it was, to my delight well secured. He waited 15 mins (Even though he had to drive back to London area in the snow/sleet)while i unpacked it and had a damn good look at it before i signed. He said it was in mine and his interest for me to check it as when i`d signed his responsibility ended.

    Surely, unless you open any package whilst the courier is there,the only thing you can sign for as "in good condition" is the box ??
