Samsung UE40ES6710 - is this a tv fault?

I recently bought a Samsung UE40ES6710 and after setting it up I realized that about 1/4 down the screen there is a faded/dimmed section of the tv. It is extremely visible on a white background. I'm pretty sure its a fault but I don't know what it is? Has anyone seen this before? I've tried adjusting the settings but cant get rid of it.
