Original xbox onto live

I've just hooked up an original xbox to live, tried to recover my gamertag i made on xbox.com and it said that it's unavailable, so went to create a new gamertag and i'm asked for subscription code, which i dont have. it wasn't this complicated on the 360!

any ideas?
