I agree on both counts Still doesn't change where the blame lies in traffic. Great that he was driving only 20mph, if not the ending could have been much worse.If I was the driver I would also be cautious, and he did say he was driving 20mph. Whether thats true or not I dont know.
But I think the majority of drivers would have fallen victim to hitting the lady no matter how careful they drive.
Practically don't disagree with that, yet that doesn't change the hazard that was present and that it is a car vs pedestrian. Hence blame apportioned to the driver of the vehicle. Would be the same thing if the pedestrian was a cyclist, or moped or motorbike. Would have been different if the pedestrian was an HGV.As much as I'm normally an advocate [read; preacher] for good observation and hazard perception, there was no reasonable way to avoid this happening on the part of the driver imo. Having watched the video multiple times, I don't see the joggers until they dart out from the front of the bus waiting to turn (not stationary/ parked/ letting passengers off either, it's at traffic lights).
