I notice that your website now features the DVD at the reviewed price of £21.99?

:mad: 'fraid I see a bit of a red flag when I get emails like this and take it as a personal insult and challenge to get justice - I do not give up (unless the company folds - they normally deserve to) and normally win.........

For info, this was my reply:

This appears not quite to be the case! http://www.thehut.com/mall/productpage.cfm/TheHut/89505 shows you are now selling said item for £21.99!!

Since your email gave an order reference and confirmed my order I therefore will be forced to take action, should you not reconsider, as breach of contract under the applicable UK law. I am sure you are fully aware of the various case law already reported with similar situation concerning purchase orders placed via the internet over the last few years. My credit card supplier will be informed and requested to initiate the proceedings.

I therefore will give you three working days to consider your actions with respect to this matter. This email has in the meantime been copied for information.

I look forward to hearing from you,

Dear Customer,



I understand you concerns as to why the DVD is still showing on the site.

Just to clear the issue up, it takes between 24-36 hours to hide a product from the site, in the interim we put a block on any products that stop customers getting through to the checkout with any un-hidden products.

Unfortunately the products still remains published during this period.



Again, many apologies for this inconvenience.

You are correct in stating that we did re-price the DVD at £21.99, but as stated earlier, the DVD could not be purchased as we put a block on the item.



Can I please direct you to section 8 of our Terms and Conditions (as listed on the website).

All orders are subject to acceptance and availability. If the goods ordered are not available, you will be notified by e-mail (or by other means if no e-mail address has been provided) and you will have the option either to wait until the item is available from stock or to cancel your order.

Any orders placed by you will be treated as an offer to purchase the goods or services from us and we have the right to reject such offers at any time. You acknowledge that any automated acknowledgment of your order which you may receive from us shall not amount to our acceptance of your offer to purchase goods or services advertised on the Website. The conclusion of a contract between you and us will take place when we (i) debit your credit or debit card or (ii) despatch the goods to you or commence the services, whichever is the earlier.

Three read receipts so far but no reply :boring:


Rekon their term 8 approaches 'unfair terms' etc as compared to their email that is sent out, which is not as bland (non-acceptance wise) as some of the more experiened etailers, the terms are too far weighted towards them and not the buyer :nono:

So two more days, but I don't see them suriving long if they treat folk like this anyway :hiya:

I got the same but I checked my account and it said 'cancelled' for my order?

Anyway I mailed them Friday with no response as of this morning.

if you look at the right hand side of the page here just under where it says "Ready to Buy" there is the Amazon Jersey price.
