    So someone has left their job but a letter was sent to them saying they owe them £50 because they over paid them to do with holiday pay,Question is can they legally get the money from them?

    Its the companies mistake they over paid them.

    Yes, it can be recovered, in the scale of things was it a massive amount ?

    No its only £50 which is not going to be hard to pay back.

    If the employee was underpaid £50 would they be happy to leave it...?

    Tell them to get it paid back.

    One of the drivers where I work left late last year and was somehow over paid by about £800.
    It was the managers mistake as he knew this guy was leaving because he'd had his notice well before the end of the month, yet somehow still managed to put his pay through for the whole/most of the month, not just for what this guy actually worked.
    Funny thing he went to one of our competitors and I was talking to him when we crossed paths out on deliveries, which is when he told me about it.
    Said he wasn't going to pay it back and at worst they could take him to court, which would cost the company more than they over paid him.
    Not sure what happened as he now no longer with that company either.

    I was overpaid when I TUPE'd between companies the last time (there have been 3!) to the tune of £457. The whole TUPE process was a farce. I didn't actually know I'd been overpaid at the time as I received no final breakdown of what my final pay bundle contained. It looked about right - about what I was expecting with pay, plus expenses, holiday pay and bonuses. THREE YEARS later I was contacted to say they'd made a mistake and they'd paid my accrued holiday pay twice. My contact of employment specifically said that, at termination of employment no claim could be made due to errors after 6 months. I guess, to protect them if they underpaid - not ever expecting to have over paid. I never paid them back - my argument was the above clause and that they should have contacted me sooner. It's not like i was difficult to track down. I'd been at the same address, with the same phone number, heck I was even at the same client and sitting at the same desk doing the same job, just for a different employer! I'd also paid Tax/NI on that amount. Never heard from them again!

    I was over paid about £250 a while back during a move from one LA to another and the advice from the union was that if it was reasonable for me to believe that the amount paid to me was correct i.e. it wasn't a massive amount and could have been tax or expenses adjustments for example, then there was no onus on me to pay it back.

    So I didn't! I wrote a polite letter to them saying that any error was theirs and I had been paid in good faith and accepted it as such. I never heard anything else about it

    The correspondence and time to get it is probably more. I get the point that they were overpaid but sometimes it's cheaper to write it off.
