I bought my iPhone 5 from and Apple store about 16 months ago, i did not get Applecare.
I took it in today to have its battery looked at, as it sometimes shut down with the battery at 25-35%, the genius checked the battery and said while it was within tolerance it was getting very close to needing replacement.
He said that although it was older than a year, and not covered by Apple's warranty, they would replace it for free as I had bought it from their store and it was covered by a European warranty.
I was not sure if it would be covered because I thought a battery might be considered a consumable.
I was very happy with their customer service, hopefully if anyone else in a similar situation they will be able to get a free battery replacement, providing the phone was bought from Apple themselves.
