    Hello,

    SplashDVD are selling Eternal Darkness: Sanity's Requiem for £3.99. This is one of the games you can use to get the free 4 game Zelda pack from Nintendo (see the Nintendo website for details).

    So this means you can get Eternal Darkness + 4 Zelda games for £3.99!

    They also have other games reduced, such as:

    Super Smash Bros Melee £7.99
    Super Mario Sunshine £9.99

    Free P+P too.

    I thought you had to buy 2 of the cheaper games to qualify for zelda?

    Yeah, you do, but Eternal Darkness is one of the "expensive ones" according to the Nintendo website...

    I believe so, I saw it discussed in the dvdforums that it would count, as long as the company is based within the UK incl jersey

    The problem really is, will Splash deliver and therefore have the receipt dated in January?

    I called Nintendo, internet orders do count as long as they are UK...

    Unfortunately it looks like this may have been a mistake by Splash - all the prices are changed now, Eternal Darkness is up to £15 now and the other prices have increased too.

    Have to wait and see if they honour the prices - I have received confirmation, just have to see if they rescind this

    I've just been to Splashdvd and they aren't reduced on the site i went on, eternal darkness is priced at £15.99, am i missing something?

    Their prices are all over the place. I originally ordered eternal darkness for £9.99 a few weeks back. Thats about 4 price changes in a fortnight

    They've just cancelled my order for 4 items, s/w error apparantly!
    I did think twice about ordering from this usleless company after their bad reputation on these forums and a friend having hassle with them. I wont use them again.

    I've just had my order cancelled too...but have emailed to 'discuss it'. I'll let you know how I get on.

    By the way, the Eternal Darkness price is back down to £8.99 now...but obvious no guarantees with this company!!!

    The Game,

    Their email says to take it up with trading standards if I dont like it! - I've read their terms & conditions which say the title to the product passes to you when they take payment (which is as soon as you order!) so if they then cancel aren't they stealing your goods!


    I might pass it all on to trading standards to see what they say.

    From law school (a while a go, so maybe there are some things I'm not too sure about...)...

    There are 3 parts to a contract...offer, acceptance and consideration.

    Offer is me ordering things from their website.
    Acceptance is their confirmation email
    Consideration is when they take payment (charge my credit card in this case)

    Because acceptance in this case is automatic and electronic this may cause some problems with legal intention to create a contract. But because they have charged my credit card this implies they do intend to create a legal contract - there is also a delay between the order and the charging of my card so it didn't happen automatically...

    Also, they have started to ship the order to me (they are sending out each item when they are available) so this also implies to me that we have a valid contract for the sale of those goods.

    This is what I have told them is my position in the email, I am awaiting their reply. I'll let you know if/when they reply.

    Please let me know what trading standards say on this matter.

    Splash certainly aren't doing themselves any favours re: their reputation with this sort of thing.

    TheGame,

    Trading standards say that Splash are in breach of contract, they cannot be forced to sell the goods at that price but are liable to compensation for the difference. They say to send them a bill for the compensation by recorded delivery and give them 14 day to pay.

    I very much doubt that they will pay this though!

    I am currently in the process of 'discussing' the matter with Splash.

    Basically with me asserting that there is a valid contract and ultimately Splash stating that "the decision has been made". They have told me to either contact Trading Standards or their director directly. I have asked them to supply an email address where I can contact him (rather than having to do this by snail-mail) but have as yet received no reply.

    So I am thinking of contacting Jersey Trading Standards to look into this (as they are available by email).

    It may take a while to get this resolved one way or another and I'm not holding out much hope that Splash will honour the contract, but I'll let you guys know what happens.

    Incidentally, even though the contract is in dispute Splash have sent all the other items in the order. But if they are claiming that there is no contract, I may then claim that as there is no contract then these goods are unsolicited gifts :)

    How bad are they for delivery times normaly, I've ordered a copy fo Eternal Darkness as well for £8.99, my card was debited on the 23rd but no sign of the game yet.
    I ordered a game from Play Wednesday evening and it arrived Saturday so it doesn't seem to be down to the postal service.

    Their delivery times are crap - stuff I'd ordered in the past took arround 10 days but did eventially arrive, the main problem is getting refunds out of them! - I waited 50minutes in a queue today to speak to them, I'll see if I now get a refund!

    After a fair few emails back and forth, Splash have agreed to honour the contract :)

    They disagree with trading standards that there is a valid contract because they made a mistake, but as I have been a "loyal customer" for sometime they will be sending me what I ordered at the price I ordered it.

    So, fair play to Splash, they are honouring the deal.

    Andrew_arkless...I found that emailing their marketing team (rather than using the form on the website) got a response fairly quickly...maybe this is better than waiting on the phone.

    The email address is on their website, I think it is marketing@splashdvd.com.

    Thats great news! - I'm not going to push them, I'll just be glad to get my £16 back, they should have refunded me yetserday so I'll give it couple of days to hit my CrCard.

    I'd never use them again because of the difficulty getting the refund (which should have been automatic when they cancelled!)
