Buying from an eBay seller question

    If I were to buy something from a seller on ebay an item that isn't up on ebay will ebay ban me?
    Will ebay ban me or the seller or both?
    The thing is the seller has a dvd listed but I asked him if he has a dvd that is different to the listing and he said yes so we exchanged emails and bought what I asked for away from ebay,

    The seller would definitely get in more trouble than you, but you'd probably get no more than a slap on the wrist anyway - especially for a low ticket item. In future, it's better to ask the seller to put up a proper listing, even if you are paying a few percent more - then at least you're protected if the item doesn't turn up, etc.

    Circumvention of ebay fee's it will fall under if you used the ebay messaging system.

    They won't know unless the deal goes south and one member reports the other sooo....

    But this wasn't circumvention of eBay's fees. He bought something that was not listed on eBay. eBay would not even know about it unless they audited the messages and even then it is nothing to do with them - it is a private sale.

    Agree with Nigel: you bought an item from an Ebay seller, but you didn't use the Ebay system to do so. Therefore, unless they vet private messages (which I don't think they do unless there's some sort of dispute between Seller and Buyer and Customer Services get involved) you should both be in the clear.

    But as Ben states, it's not good practice on your part as you have no consumer protection using this method. But as a one-off on a low cost item, then it's probably worth taking the risk if you're happy to do so.
