Sorry to hear your disc is cracked. How did that happen? Microsoft should be able to provide a replacement. After all you paid for the game not the disc.

I think you'll just have to buy a new copy . As far as i'm aware, some of the early games were made on cheap media (hence the failures). I don't think that MS will replace the game but it's worth giving them a bell.

Claims under the 90 day warranty must be made to the retailler with the original receipt to prove date of purchase. As you bought from ebay and do not have a shop receipt then you have no way of proving that the game was bought new within the last 90 days (the 360 has now been out over 3 months so there's a chance that it is now outside of warranty anyway).

Good luck, be firm with them. I really think you are entitled to a replacement. You paid for the software not the piece of plastic so you should be entitled to a replacement. Let us know what they say.

Buy a pre-owned copy from GAME or Gamestation, return it say it was cracked and you want a refund.

Well honestly what did you expect?

Come on, show some sense, if you crack a Music CD do you phone the company and ask them for a reaplcement?

If a DVD cracks do you phone MGM?

This makes me so angry to hear this.
This is really treating customers like crap with this kind of attitude from MS.
Best thing to do is send your cracked disc to MS recorded delivery with a letter of complaint demanding a replacement.

How? If the 360 didn't crack the disc then why should MS replace it. As far as I'm aware the poster hasn't mentioned how it cracked so, I'm not saying it is, but it could be his fault.

When I go to the shops and I spend £50 on a game, I am paying for the software, not the piece of plastic. It's not the same as breaking a piece of hardware. So why shouldn't he be entitled to a replacement even for a small fee? I don't understand why this would pose such a problem for Microsoft. This "no replacement policy" only gives argument to peoples' entitlement to make back ups of their discs and hence promote piracy.

I am in the same situation as you.

My PGR 3 disk is cracked and will not work now

Also got a small crack on my Ridge Racer 6 disk, that still works (for the time being anyway)

Called MS and they said they carnt do anything told me to call the people who made the game Bizzare Creations. Carnt find a number anywhere and MS Support line dont even have a number.

I brought the disk second hand from the forums, so no reciept.

Mate of mine told me to go to Tescos and ask for a replacement and they should do it. Just tell them you dont want a refund or another game just a striaght swap and they should do it.

Cheers Ben

i had a call of duty disk cracked and sent it to activision by recorded delivery and they replaced it for me, i know its not PDO but if you send it direct to RARE i'm sure it will be replaced, i know sometimes it cost £10 to repace disks as with EA games, it should say in the booklet somewhere.

Why is it MS fault if you damage software? Dont tell me "the console did it"

The software has absoluely nothing to do with MS other than they allow it to be released with their logo and badge on it for thier console. Its the software manfacturer that you should be contacting not MS.

Tbh if it were me id tell you to get on yer bike aswell, They have no substantiating evidence that you didnt stand on the disk, so why should anyone replace it?

i have owned consoles and computers of some description for the best part of 20 years and have NEVER had a disk crack, game break or cart crack without input from ME.

imo you need to be more carefull with your software and it wont break!

I agree that it is not MS at fault, it is the software companies for using cheap media so take it up with them and I am sure they will replace it, after all I doubt you are the first to complain about a cracked discs as alot of people on here have experiencde the smae problem with a wide range of games, luckily I have yet to have any trouble.

That's not really fair, alot of people who have posted on here regarding cracked discs have done nothing more than play them and put them back in their original case, how much more carefull should you have to be?

OK maybe the game developer should replace the software not MS. Lets say you are responsible for damaging the disc, so what. It wouldn't take much effort for the game manufacturer or Microsoft to replace it for a small fee rather than just say tough luck. I myself have never broken a disc but I just don't think this is the right approach for a game that sells for RRP £40 - £50.

Should the same approach be taken with digital distribution. So if one day in the future your hard drive fails with 10 games you bought worth a total of over £400 it will just be tough luck, pay for them again?

No, that's a silly argument since with the 360, when you pay for content, you can redownload it on a new hard drive if the old one packs up, it's linked to your Gamertag.

But you haven't been into the shops and spent £50 on a game, your Gamercard says so - you've only played 4 Live Arcade games.

I'm not sure I understand your point by refering to one of three of my gamertags. I didn't spend £300 on a next gen console so I could simply play on XBOX live arcade.

Anyway, there seems to be a difference on opinion on this so we'll just leave it as that and best of luck to redman_5 in getting that replacement disc.

There is a warranty of 90 days on games - companies can't just give out infinite warranties as people could be coming back all the time asking for new copies of games. The media may not be that expensive to produce, but they would seriously have to increase the size of that distribution arm if they implemented infinite warranty procedures.

You are also buying an instance of that intellectual property, not the right to have as many copies of it as you want (so that you can keep replacing broken copies). People pay a lot of money for high end designer clothing and a vast amount of what you pay goes on buying the right to wear that piece of intellectual property (i.e. the exclusive design). Your argument would mean that if you destroyed or damaged your garment, then you should receive another one at cost. This simply wouldn't happen.

At the end of the day, the disc is protected from poor workmanship for a period of 90 days, which is fair enough IMO.

Software is very different to designer clothing so it's very difficult to draw a comparison there. Damaged discs are a rare occurance and it's just nice to know that if in any event it's damaged during a period when the game is still being widely distributed and sold that it is possible to get a replacement at cost + handling & administration or whatever extra fee. They could charge lets say a £10-£15 replacement fee which is better than paying £40-£50 again and keeps a happy customer.

The cracking discs issue is well known. Phone up the cutomer service line in the handbook - you should get a replacement as this does not constitute a reasonable period of time. 5 months for a game is not on.

Do NOT pay for a new copy. If you have problems, I will phone them up for you. Im not in a good mood today so fishing to rant at someone.
