about to send mine off for RROD

friend did the same last week - and he apparently is receiving a replacement 360 that is older than his last one with a different serial number ?

now surely this isn't fair

its fair enough that they give you a 3 month warranty, but you don't know how much usage that refurbed 360 has had from the previous owner ? Its not like when they refurb your 360 they replace every internal part.

I suppose I'd equate it to (assuming some of the parts within the 360 are lifed or at least heat cycle lifed) - taking your car to the dealer to get fixed, and say cars don't have mileometers on them - you take your 20k mile car in, and get a 150k car back.

I use my 360 perhaps for an hour or so an evening - casework is in very good condition etc, I'm just annoyed that I could get a refurb back that has been used by a serial gamer for say 10 hours every day.
?

If you specifically state that you want the same console back - ie yours repaired - are MS legally entitled to ignore that request ?

I'm sure it's a case of "get what your given" with them mate, unfair I know, I'd of liked mine back too.

Refurb means it's been *fully* refurbished and the console is *as new* and is fit for sale.

if they are genuine refurbs - like Apple IPOD refurbs (which are spotless), refurb like you say - should mean "as new" - therefore casework should also be replaced

so presumably any marks/scratches etc on the replacement refurb 360 would give you grounds to refuse it ?

They are obliged to give you a working 360 in reasonable cosmetic condition. No more, no less.

If it's in poor condition I'd say you have a right to ask for something in better shape.

Fingers crossed you get a new one though (I did back in November).

The first 360 I sent for repair had a few scratches and when I got it back (same serial number) the full case and faceplate had been replaced. I also sent another 360 away for repair and the replacement I received was an older console, however the DVD drive had been changed to a benQ ,which was way quieter than its predecessor, the motherboard and gpu were also replaced.Overall I was happy with the service (shouldn't have happened anyway though imo )...You never know though they may just send you a brand new console.

Only time ive sent for repair ive had the same 360 back with letter stating what was repaired/replaced. Guess its just what u get, tho i have all the lettering on my 360 coloured in so mayb they thought, "better repair and send this back as he's gonna know"
Take note of serial number and see if u get it back, Dont really matter tho does it.

only time it would matter is if you sent them a HDMI enabled 360 and got one back that didn't have a HDMI port on it

My first was repaired, but the case definately came back in a worse state than what I sent in.

My Elite is due back today and is claimed to be back repaired, I wonder what new scratches it will have.

Yes, because MS have no legal obligation except to fulfil the T&Cs of the warranty. To quote:

D. YOUR REMEDY.

Your remedy is either:

that said any T&Cs of MS are IN ADDITION to your statutory rights which say if you have a repair it has to come back in same as condition ...

that said I was looking at Arcades today - going to get an Arcade in the meantime, a Jasper - 129 pounds inc Fable 2 from Game

then sell the refurb on when it returns - should be able to get about 50-60 quid for the bare XBOX (without HDD but with controller) with 3 months warranty I would have imagined

makes it about 50-60 quid then for a brand new one instead
