DVD drive replacement

For about 10 months now, my 360 have been tempremental when it come to loading and playing certain game. The white screen saying "put disc in xbox 360" and "unreadable disc" failures are seem to effect certain games (mass effect and forza won't load!), but now that gears 2 won't load- i need to sort it out.

I don't want to try and pass off my console as fully working on ebay, as i don't think that it is fair to the buyer, and selling as faulty would get me enough return.

As my warranty is now out i want to change the DVD drive. My problem:

1. I don't want to get my live account banned, as i'm not modding my system to play copied games, if i change the drive am i ok?
