Are toys r us allowed to do this?

Just called my local toys r us up to check stock for ps3's and they said they had them in stock but I can only buy a bundle. I want to buy games anyway and a bundle wouldn't bother me if it wern't for the fact that they give nhl of all games why nhl. I asked if i could buy the console on it's own I was told no. Is this allowed? Do you think I could maybe get one if I spoke with a manger, before anyone asks why I don't just buy from another shop, I have vouchers and want to use them rather than using £500 odd cash. Any advice much appreciated.

No thats Illegal, If you ask to have it broken down then they need to sell it to you. Best idea is to stick it to them by buying elsewhere. Thats the only way they will learn.

There not allowed to do that i don't think why don't you go to Woolorths they are supposed to be doing the best bundles.

I think that as long as Toys R Us are not advertising the PS3 as being available to purchase by itself, they are well within their rights to only sell as a bundle.

Why would they need to break it down. Could you go to a car dealer, and say you only want to buy the car without the wheels/engine?

Like I said above, if they are not advertising the PS3 as being availble separetly, they are well within their rights to only sell as a bundle.

At Darren eaf No they are not. Go and phone trading standards. They will tell you that they can do bundles but if you ask to buy just the PS3 then they must sell it to you.

Why not go elsewhere though? Toys'r'us suck.

I don't think Toys R Us are doing anything illegal, as a retailer they offer goods for sale and are able to offer any configuration of goods they like, as the buyer you choose if you want to do business with them.

I still say its illegal to refuse to sell just the PS3. Phone trading standards and see. Its like an old law to stop traders from selling unwanted goods bundled with goods in high demand.

If youre correct, then that law is redundant, since a retailer can refuse to sell a product to a customer at any time.

If it is legal to only offer bundles then what does that do to your rights with the NHL game? Shouldnt you be able to return that product?

when i bought my 360 from the toys r us in manchester I got the manager to change 2 of the three games. He was quite happy to do it and I saved loads of money compared to game and gamestation etc. Always worth chatting to the manager

Had a look on eBay and PSUs are pricey but wired pads are dirt cheap.

How can this be illegal. Its like walking into tesco's and ripping out a single can from a multipack and telling them to sell it to you. The retailer can sell it however they like to you (as long as they are not misrepresenting it), its up to you to go else where.

Wait a week or so and thanks to the poor demand, my money is on the packs disappearing / becoming a lot better value.

Have you phoned them yet Ninjapaul? If so, you now stand corrected

As has been said many times above it is not illegal for them to refuse to sell the individual parts to you. They can refuse to sell you (or me) anything in their store, for whatever reason.

I think your understanding of contract law/the sale of goods act(s) is being tarnished by your understanding of antitrust/unfair competition laws!

do what i did, get the bundle and take the game back and say i would like an exchange or money back as you already have this game brought by someone else, their store policy allow returns if item is still wrapped and unopened on computer and video games and the game is indeed shrink wrapped, i swapped mine for F1, they jusy gave me store credit receipt to the value of said item, £39.99, so off i went with it and got F1

There actually was a long post over on the 360 forums about bundles when the 360 launched. It was *Game* that time. People found a quick call to head office with the mention of trading standards got them just the console everytime.

Have their HO call the manager of the Toys 'r' Us.

A shop is not required to sell you anything, or at any price on display. They are making what's called an 'invitation to treat', which can be withdrawn at any time.

Even if thought you had proven the goods should be offered outside the bundle, they are not obliged to sell it.

edit. However, if (thought unlikely) toys 'r' us were obliged to sell the PS3 seperate, they could sell it for £1000 if the really wanted, £425 is just a recommended price.

CORRECT!!!

Remember bundle deals by retailers are nothing to do with the likes of $ony or M$ they are simply adding separate items to the deal and charging accordingly. The seller has a right to refuse sale, to sell at any price they wish and unless the item clearly states that it is part of a multipack as many or as little items together. Calling a companys HQ may result in a bit of customer goodwill for you but the retailer is simply trying to maximize its profits on each hardware sale as the hardware makes so little profit - EVEN AT £425 a pop!

My wife work's for trading standards and she has just told me they have been getting a few calls regarding this and I'm afraid she says that they are not doing anything wrong at all in only choosing to sell bundles

The only thing a retailer cannot include in a bundle or force you to buy in any other way is an extended warranty. Other than that they can add what they like and charge what they like.

As a senior retail manager with knowledge of the law i can assure everybody that they are well within their rights to sell only as a bundle if they want, you have no right to demand the ps3 on its own any more than you have the right to demand "just the psu out the box please" from the retailer. The retailer doesnt have to sell you anything, they dont even need to let you in the store if they dont want to. The only laws really surrounding retial apart from the generic h&s laws is the sale of goods act which states the goods must be as described and fit for purpose.

And general contract law of course.

As has been touched upon above, whilst a store can stick to the law, often this isn't good for business! Hence why you'll often get somewhere if you go to the manager or contact head office. You have no rights to demand anything, they'd just prefer to have a happy customer (as long as you aren't taking the p1ss) than an ex-customer.

Really,if you want a PS3 just buy it somewhere else and use your Toys R Us vouchers for games for it. It's not like the situation with the Xbox360 and the Wii where you more or less had to take a bundle from any retailer because of stock shortages.

There are plenty of places that you can simply pick up a PS3 (in fact, they'll be more than happy to shift it from a bulging stock room). Exercise your consumer rights that way instead of worrying about hypothetical legalities. If it vexes you so, write to your MP or something afterwards.
