Volume on NW-HD5

I have heard that the volume on this new model is restricted by observance of EU recommendations.

To what extent is this the case as my hearing is starting to deteriorate slightly and was wondering if I would be better with an Ipod or some other makers most recent model.

Any views?

I have many mp3 tracks on my computer can I transfer these directly onto the HD5. Is there any advantage converting them to ATRAC3 other than size/compression.

Thanks for any help from an old & not very technical beginner.
