Banned, Fined, But NO points?!

Hi people, I was wondering if you lot could help me with this dilemea.
Last year i was court speeding and got a court summons, i recived an SP30 and CD10 as well as a 42 day ban and £300 fine in total but recived no (zero) points.
When i recived my licence back in the post it had my SP30 with the 42day ban, £150 fine and 00 points all on the same line for this conviction. however on my CD10 it only has a fine (£150) next to it with 00 points? no 42day ban!
Now how dose that work?
Dose that mean i only recived my ban for the sp30 and not the cd10? if so do i still need to inform my insurance about the cd10 even tho i recived no point or ban for this offence only a fine?

Would love to hear your views.
Cheers

Re: Banned, Fined, But NO points?!

Bit of a confusing post.

Am I correct in thinking you got the 42 day ban for SP30 an CD10 combined? SP30 on it own doesn't normally lead to a ban, unless you was doing excessive speeds.

Either way, you will have to disclose to the insurer you have a CD10.

Re: Banned, Fined, But NO points?!

yes i was doing excessive speed 115.5mph! silly i know.
i thought i got the 42 day ban for both but it only appears on my licence next to the sp30 and not the cd10 thats why i'm a bit confused. otherwise i would of thought the ban would be next to both sp30 and cd10.

also any idea how long these stay on my licence for?

You have to disclose any bans or convictions in the past 5 years (could be 4)

How points on your license normally work is - they remain active for 3 years(for totting up purposes), but you cannot apply to have them removed until after 4 years...even though they do not count for the last year.

This is different to insurance purposes, where they usually ask you to go back 5 years...even though there could be no physical evidence from year 4 onwards.
Thats quite a speed you achieved on a non motorway road. It would be an automatic ban under the SP30.
I dont understand how you could have received no points though.
I have never been in the position so i dont know....but surely one cannot receive a ban without also receiving additional points...or does an immediate ban prevent any further points being issued?
Im sure there must be people on here who have been banned at some time or another, so they should be able to state if they also received penalty points.

Your circumstances would certainly warrant it.....exceeding speed limit by at least 45mph, and driving without due care and attention.

Bit random, but a lot of cars will reach that sort of speed now.

Pretty much every rep mobile will which i would guess what the op was driving just by stereotyping fast drivers.

Re: Banned, Fined, But NO points?!

AFAIK, you if you receive a ban you don't get points as well. You can however be banned due to totting up enough points, so although the sentence may only be points and no ban, if the new points added to any existing take you over the magic 12, then you are (probably) banned. Strangely though, some people manage to still escape a ban if they can prove to the court that they and others (family) may suffer unreasonably (loss of job, serious drop in income etc) as a result of a significant ban. I know several couriers whom have/had over 12 points at any one time and were still driving legally.

Yes, my father managed to have 12 points and no ban at one point. Told the court he was an idiot, but required driving for his job etc. They let him off on the grounds that 3 points were due to come off in the next few months anyway.

Re: Banned, Fined, But NO points?!

i had 6 points on my licence from 2 silly 30mph speeding incidents. then disaster dtruck when i wrote off 2 lorries on the m6. the magistrate charged me with driving without due care and attention and enforced 7 points on my licence thus disqualifying me under the tt99 ruling ( totting up offence) i was banned for 6 months and after that period i got a luvly shiny clean licence back with all my hgv entitlements still intact.
the points that got u banned dont appear on your licence because they have already served their purpose ie they got you banned.

Re: Banned, Fined, But NO points?!

10 years ago I was banned for speeding on the A1(M) - 109mph on a fine, clear day with no traffic around (i.e. not dangerous...) etc

I went to court to plead guilty and was given a 50 day ban (SP50) but no points.

Clearly the ban itself needs to be stated to insurers (with the associated increase in premium etc) and you will need to make it clear that you have an SP30 AND CD10 on your licence, but from a totting-up perspective, you are on zero points.

Drive safely!!
