3 Increasing charges

Just recieved a letter from 3 informing me that from 20/10/08 there will be a £1 charge to carry on receiving itemised billing.secondly from 20/09/08 all calls and voicemail under a minute will be charged as a full minute. This was not the contract i had with 3,I dont want these extra charges forced on me.Anyone think I might be whithin my rights to cancel the contract halfway through the 18 months.

Yes, you are entitled to cancel the contract half way through and lots of people have already done this. There is a large thread under the Mobiles section of Money Saving Expert forums on this. Some people had to be quite insistent when trying to cancel - quoting the exact terms and conditions, and even emailing 3 chief exec office, but it can be done if you really do want to cancel and move to another phone contract.

You can end the agreement during your Minimum Term (if you have one – this will be stated in your Price Plan) by giving notice to 3 Customer Services at least 30 days before the date you want to end the agreement. However, you must pay us all the Charges you owe, plus any Cancellation Fee for your Price Plan (as set out in the Price Guide).
On 30 days' notice, outside the Minimum Term. You can end the agreement if your Price Plan does not contain a Minimum Term, or if you want to end the agreement at the end of your Minimum Term or any time after your Minimum Term has expired, provided you give notice to 3 Customer Services at least 30 days before the date you want to end the agreement. (A Cancellation Fee will not be charged.)
Within one month of a detrimental variation to your agreement. You can end the agreement within one month of us telling you about a variation to your agreement (which includes your Price Plan) which is likely to be of detriment to you. You must give written notice to 3 Customer Services within that month and your agreement will finish at the end of that month once we receive your notice. (A Cancellation Fee will not be charged.)

Re: 3 Increasing charges

My letter was received this morning in Glasgow, so am expecting a call today from them. 50% of my calls are <1min so this does affect me, not looking forward to the inevitable arguments with CS.

It also seems to depend on how you inform them - if you ring or email you seem to get the Indian call centres who have little interest/power to help you. A letter direct to Glasgow's office seems to be the better way (at least I hope!!!), plus it does explicitly say to inform them in writing.

Re: 3 Increasing charges

The key date is apparantly oct 2007 any contract prior to this and you can cancel, anything after and you cant. I phoned up yesterday and they were talking about offering me an upgradem someone was meant to phone me back today but they havnt so far. Im going back on the phone to arrange the cancellation as you then supposedly get the "offers" to keep you during the last 30 days. If i dont get a suitable offer ill probably rejoin them as my wife is with them and we would both get a £45 credit and also £60 going through quidco.

If you do phone dont get involved arguing with customer services just tell them to put you through to cancellations.

Re: 3 Increasing charges

Would this do:

Dear Sir/Madam

Mobile Number: ***** ******

Account Number: **********

Following the recent changes to your call charges as per your letter dated 5th August 2008, as these changes are of detriment to me I am writing to give you thirty days notice to cancel my contract, as set out in my contract in parts 4, 4.1b(ii) and 10.1(d)

Please can you confirm as soon as possible that the contract will be cancelled after thirty days. I understand from the contract that no additional charges will be made for cancelling the contract.

Thank you for your past service.

Kind regards,

xxx

This seems to be their get out tactic, but I honestly cant see this as legit. As far as I can tell, their changes to per minute billing are only coming into effect next month for non-m&m contracts, so how this is covered by any previous agreement is beyond me - the fact they have sent out the letters now, as per law indicating a change is surely the key and therefor it follows that the T&C still apply??
