Mobile phone warranty problem

Mobile phone warranty problem

Hi
I bought a phone, SE K510i, on 30/06/06. It had a fault and was sent off on 18/11/06 for repair. It went back to the manufacturers, who said they can not fix it, and I caused the fault, (the thumb stick stopped working). Now the shop phoned me and told me they can not replace or refund as the fault was not covered by the manufacturers warranty. Carphone warehouse state they only replace or refund if the fault is within 28 days. My phone is under 5 months old, I thought under the sales of goods act I had "reasonable time"
Any help or advice would be appreciated

I thought that SE's had a 2 year guarantee (am prepared to be proved wrong though)

It sounds like it's broken through reasonable wear and tear - thus, I think there should have been no problems with it going back to SE under the terms of the warranty to be repaired.

Not sure about the Sale of Goods Act. I have heard that CPW are hard on giving refunds, so you might have to speak to someone who knows something about this act on a more professional level.

That covers normal breakdowns...not misuse...which is what the manufacturers are saying, you'd need to prove you didn't break it and that it is an inherent fault or breakdown I would say.

the joystick not responding correctly is a common problem on these and would be covered, but if there is any physical damage then it would not be covered.
would still be repairable though through an independant repairer (not for free though)

Your consumer rights last for 6 months, on top of that most of the phone manufacturers from april 2005 extended their warranties to 2 years. That sounds like a manufacturing fault, and unless they can prove otherwise you should get the benefit of the doubt. Keep at it and dont give up
