Had it longer than 14 days Oh Dear!

I have and XDA11i from O2 I have sent it to be repaired 4 times now they exchanged it for another one after the 3rd but as a phone it is total and complete crap!
I have just had to send it back again because the sound has now gone!
I know that they say if you have your phone longer than 14 days they can't really do anything about any faults! but surely thats total crap! we have right as consumers and just because they have a 14 day rule that surely can't effect our rights as a consumer?

can anyone who has had similar dealings with O2 let me know if they can enforce this stupid rule?

Have you tried contacting Trading Standards for their advice?
It is the consumer law which is the overriding factor in these cases and not some policy or rule which the company tries to impose. Some companies seem to try it on and hide behind their so called policies which have no standing in consumer law.
I would have thought that you would expect a mobile phone to last for more than 14 days before failing otherwise it could be considered as not fit for the purpose.
You may be entitled to a replacement or refund. But find out your exact rights first. Then you can speak to them or write to them with some authority and backing. But don't be put off by THEIR rules.

I believe for faults the time is 28 days.

So you might be within that time limit.

Any time limit which a retailer or supplier tries to impose has no legal standing in consumer law. They hope that their customers will believe that they must stick to these time limits.
The essence of the problem is that the item must be 'fit for the purpose' and this would include it giving faultless service for a reasonable amount of time.
I hardly think that 14 or 28 day is a reasonable time for a mobile phone to last.
Be firm with them and let them know that you are not going to stand for their 14 days nonsense.
If you get into real difficulty with them try phoning a Birmingham based consumer show 'The Ed Doolan Show' on Radio WM. He deals with many similar cases to the caretaker's. The show is broadcast Mon to Fri 10am to 1pm and the phone number is 08453 009956

no your right shops offer more then they have to and by agreeing to the repair you dont really have a leg to stand on check with t/s but i worked in retail for a long time and am pretty sure of this
