Thumbs down Unauthorised account upgrade and unauthorised direct debit taken - Where do we stand?

afternoon all,

My fiancee was with Vodafone, when she went to leave and get her PAK code she was told that her contact had been renewed without her permission after a sales person had called and was told she didn't want to.

The person she spoke to allowed her to have her PAK code so she could move and said she had no outstanding balance to pay. She has since moved to Orange and last week found out they had taken out £81 without informing her what it was for.

She had no bill through the post, or by email. No phone call and she couldn't log onto the Vodafone site as she had cancelled her contract by moving. She rang up and was told that it shouldn't have been taken and that she was due a credit of £69, which they weren't going to send until she had rung up.

I sent a letter to their complaints department and someone is ringing her this evening but we want to know where she stands with regards to some kind of compensation. When she went to cancel, the bloke who gave her her PAK code said she could prosecute the person who unlawfully renewed her contract.

Is this correct? To be fair the bloke cancelled her contract and she was prepared to forgive and forget until they took the £81 out and weren't going to inform her of the credit. Because she hasn't had a bill we have no idea what the £81 was for, or what the £69 credit is for, or if she is due the £69 on top of the £81. To be honest it's been a complete cock up on their part.

Would it be wrong to ask for some kind of goodwill gesture/compensation?

Cheers

I think the first thing to find out is whether the credit is additional to the £81. Also vodafone record their calls so you have the option to request a copy I believe.

You probably should get some short of gesture but it's not definite, more than likely be an extra credit.

I can never get into the website either. Get it in writing on what you agree to as well once you get a figure of how much credit you are due and anything else they offer.

Hi

When did they take the £81? Its is only been in the last week or so call your back and dispute the charge. I had this with O2 once when they took £600+, in my case the contract had been canceled under the 14 day rule but they wanted me to pay the full 8 months of the plan.

well they sent a copy of a ball, and it seems the bill was for 2 months worth, even though she pays monthly by DD. Spoke to the complaints department who confirmed a refund was on the way, in fact she said she might get it twice as it appeared that someone else also put the credit through.
