Cooling off period: Whats the score ?

Question Cooling off period: Whats the score ?

I have a friend who has been with T-Mobile for 7+ years. He agreed to re-new his contract a week ago and T-Mobile were sending through a Sony Erricsson Sateo. There has been no sign of the mobile phone so he called T-Mobile today to find out what was going on. Apparently Sony have recalled all Sateo phones and this was the reason his hadn't arrived (nice of them to tell him). After having a play with my iPhone he has decided he would like to jump ship and get an iPhone with either O2 or Orange. Where does he stand with cancelling his T-Mobile contract and getting a PAC code ? Can he quote the "cooling off" period and ask for a PAC code ?

well if he never recieved his phone he should be able to cancle it no problem.
