Hmm, tough one. I wouldn't be surprised if that's in every contract, not just a business/Venture contract. However, what that doesn't say is that Orange is allowed to change the service plans to your detriment and alter your rights. Those are the key two phrases from 4.3 to focus on. Have a read of 4.3 in your contract - if it's the same as in the BitterWallet article, then I would say that you can probably still cancel.

I'd be interested to see how it also ties in with statutory rights - nothing in any Orange contract can supersede statute! A contract is any agreement between two parties entered into voluntarily, but it can be broken/cancelled if any terms in the contract are contrary to the law.

No it's not the same.

There is a clause that says that if there's a conflict between the Venture terms and standard Orange Network terms "the latter will prevail", which is all well and good but doesn't make arguing the toss with their retentions department easy.

if anyone cares, the Venture T&C are downloadable from the link below, but it arrives as a file called 'satellite' which needs the .pdf extension adding manually and is the sort that won't allow text copying .

I have issues with clause 12 in your t&c - I'm not entirely convinced that's legal. Reserving the rights to amend the t&c is one thing (and even that might be debatable), but doing so without notice I'm not so sure about.

If you can't get a straight answer, I would ask Ofcom directly. Link to the consumer advice on mobiles below - you can email them, too.

Good point. The weekend beckons, so I'll have a go at this next week. Thing is we've got quite a good contract (including unlimited calls to landlines and Orange) so I need to do a lot of research about whether there's any advantage to giving it up.

Your help is appreciated.

Out of interest, I found this summary of just about everything consumer-related on their site, using the "find documents" tool (specify codes/guidelines 2009) on their site:

Scroll down to point 9.3 in Part 2, and you will note that it states quite clearly:

9.3 Where the Communications Provider intends to modify a condition in a contract with a Consumer which is likely to be of material detriment to the Consumer, the Communications Provider shall:

(a) provide the Consumer with at least one month‘s notice of its intention detailing the proposed modification; and

(b) inform the Consumer of the ability to terminate the contract without penalty if the proposed modification is not acceptable to the Consumer. 9.4 For the purposes of this Condition,

(a) ―"Communications Provider" means a person who provides Public Electronic Communications Services, excluding any service which is a broadcast of television programmes for general reception in, or in any area in, the United Kingdom, where every member of the intended audience of such a service is able to receive that service in an intelligible form and free of charge;

(b) ―"Consumer" means any natural person who uses or requests a Public Electronic Communications Service for purposes which are outside his or her trade, business or profession.

anyone here got any experience with quidco and tracking times:

ordered the 1 month 02 sim only one by mistake on monday and it was tracked by the 5th - £100

cancelled this on the 4th and ordered the 12 month sim only the same day and its still not tracking....

tempted to order another one and if thats tracking shows up then il cancel the one from the 4th....could get a bit messy....

anyone see any downsides to doing this? also this may be odd or daft but say i did order another one just in case, since the offer ends on monday midnight, that would give me from today till monday - heres the odd question, does quidco operate on weeekends? lol i.e could the status update and show a tracked transaction on the weekend?

I think someone posted to say that the £100 cashback offer was running out on 3rd August. This was apparently on the main part of quidco's site as an article or something. I would check it again (perhaps even email quidco to ask) - I know the link still says it's £100 cashback.

So tempting to join the club on this and force an early upgrade, but I'm a mere month away from officially being offered the chance for an upgrade anyway and since I don't really fancy the idea of cancelling the contract I guess I'll just end up waiting it out.

they are refusing to cacncel my contract.. i have had the text today from them, saying its not a breech as it doesnt go over the rpi of 2.5% i asked how she can work out that 5p to 15pis below 2.5% she is now put me on hold.

I asked for her full name and she refuses to give it to me

right rang back, this time said I had received a text and could he explain it to me. He said let me check your account to see what mins you have been using.


5 mins later he came back on the phone saying as im close to using all my mins each month I can cancel with no problems at all, so he cancelled my contract as of monday.

he did say if i was no where near my total allowance i.e have 400 but only use 200/300 then they arent allowed to cancel them anymore as of yesterday as the orange legal team dont think it is a breach anymore and once they have clairfication in a day or two they are in all likeylyhood gonna stop canceling the contracts..


he told me this after i had cancelled so he wasnt trying to stall me or stop me from doing so just chatting...

Hi I'm new to this so forgive me if I get things wrong. I popped into a phone shop today and they told me about what was going on. So I tired to cancel my contract but orange say that I don't count as I don't call 0845 numbers enough. Is this right?

Tried this and was told I don't go over my mins each month so it wouldn't affect me! Told him that it will do in the future if I do! Told him if I was to use all my mins up this month then call back. Then I would have gone over the minutes and by their "rule" (which they've made up) qualify. He said I would if it had generated a bill.

Is this worth a go, using all my remaining mins and then call back?

Tell them to do one. You don't have to go anywhere near your limit to cancel. If you want to say somehting, tell them your job is changing and you'll be using your phone more in a month or so.

Yeah, sounds like Orange are pushing their luck - probably because they're losing money hand over fist on this one.

Make sure you're fully equipped with all the relevant documentation when you ring, though - makes it easier and more persuasive when you're calling and are able to quote directly where you think Orange are stuffing you.

Remember that a contract is a legal document whereby wrongful repudiation by you as the consumer entitles Orange to charge you the outstanding amount owed

If you only make a premium call on occasion then I would think very carefully before contacting Orange asking to cancel if you are not prepared for your bluff to be called

I have no doubt that Orange contracts details the notice period, the right to change terms and conditions, and the procedure in the event to a change in the terms and conditions
