Cancelling an order with DFS
Hi.
I know there are topics around this particular subject and store on here, but the threads are fairly old and I need some up to date information.
This evening myself and my partner went into our local DFS store to look at some new sofa's. We found something that we both absolutely loved, and whilst we were not pressured into buying anything or signing anything we agreed to a purchase which we were quite happy with. We opted for the buy now pay later option interest free for a year and signed all of the relevant paperwork. We left the store at approx 6pm and went round a few other furniture stores looking at lamps etc. To cut a long story short we found something that we both loved even more in Barker and Stonehouse. We went back to the DFS store at roughly 7.30pm and asked if we could cancel our order. Spoke to the salesman that we originally saw and he said that its been ordered, which I find hard to believe given the time of night. He said usually we couldn't cancel but would speak to his area manager before he left tonight and call me back....which he hasn't done.
Can anyone please give me any advice on whether I am now obliged to fulfil the agreement I signed, or is there some unwritten law somewhere or something similar that would allow me to cancel it.
I will be ringing the store first thing in the morning, but I find it hard to believe that an order has been put through and production started on something within a matter of an hour and a half...and at that time of night !

Hmm, i would simply make sure they were more than aware that you dont want the sofa and dont allow any payments to be made, perhaps you could also write to their head office saying you felt pressured to buy at the time?
its at their discresion to terminate the contract i cant see them being so desperate that they will drag you through court over it?

i am sure there is a 24hr or 7 day cooling off period to any contract. Don't worry though, i am sure you will get it sorted without too much hassle, i bought a sofa suite from DFS and although i didn't cancel my order found them to be quite helpful

Read the T&C on the back of contract they gave you
When we bought our sofa from them recently, the sales told us before we signed that once ordered we couldn't cancel

It's a difficult one.
There will definitely be a cooling off period for the credit agreement, but not sure about the sofa.
Cooling off periods are generally for distance selling, or where the seller has made the first approach or where you can't see or examine the goods.
Going into a shop, examining the product and agreeing to buy it is more tricky.
My advice would be
(i) Look at the T&Cs on your paperwork and check whether that says anything (I suspect it doesn't).
(ii) Persist. Put your request in writing.
(iii) Try things like, you've just double checked the measurements and it won't fit. You have had bad financial news and you can't afford etc.

Why you buy a sofa through interest free credit it's the credit company that owns the sofa
The agreement starts the moment you sign the contract

i was under the impression that with any purchase you had a cooling off period of something like 14 days. This happened to me in DFS my wife ordered a sofa while i was away i went in at the weekend tried to cancel and they refused. I then went Ape at the salesguy shouting about my statuary rights and explaining under no circumstances would we accept delivery and they cancelled it. I think they were worried about me scaring other customers away

Yes. In certain circumstances ie if you are cold-called or sign up to something over the phone or internet. If the customer makes the initial visit / enquiry / approaches and signs up for a product or service then there is no cooling off period providing the contract is within the law / correctly executed etc. etc.

In that case do what i did scream blue murder till they want you out the store. It worked for me. Although it seems now that everything i said to them was complete rubbish but hey its the end result that matters

I'm not sure where you stand here but usually custom made products (you can argue it's custom because you may have chosen colour etc.) don't get the same cancellation rights as off the shelf products.
