Ebay "unpaitd item" dispute

Ebay "unpaid item" dispute

I bought a box set of CDs using Buy It Now on 8 Feb. They have never turned up. I emailed the seller a few times and he never responded, but the other day he filed an "unpaid item" dispute against me.

I have definitely paid, using Paypal, and have of course stated this.

How on earth can Ebay even open a case on this? Aren't there systems sophisticated enough to record that I have paid, and thus prevent the seller claiming I haven't paid?

Am I going to get a strike for this?

As PayPal is linked to ebay id say its nigh on impossible for you to get a strike - the best thing to do is go to 'my ebay' and check on the 'items ive boguht' pain what icons are filled in (feebdack left, payment sent, order dispatched etc etc). If the payment sent icon is filled then youve got nothing to worry about IMO.

Thanks. I definitely have paid, I'm looking at it now on Paypal.

What is odd however is that although it showed on ebay that I had paid, when the seller filed the dispute, it changed to "unpaid" and a message popped up on the screen telling me that as such. I clicked on the icon to change it back to "paid", and now when I hover over it, it tells me I paid with Paypal on 3 March. Yet I'm looking at my Paypal history now and it says I paid on 8 Feb.

It seems that Paypal and Ebay aren't as integrated as I thought.

This is getting pretty bad now. I have been given an unpaid item strike and ebay reports "This case is closed. The seller chose to close the case. "

How can the seller close it? Why is the system on the seller's side?

they should rename it to scambay and scampal

the whole thing is falling apart with there ridiculously high fee's and stupid rules and refusal to talk to people.

Have you actually been in touch with ebay and the seller since the dispute was raised? You don't mention whether you challenged it in your original post. There should also be an option on your 'my ebay' page to raise your own dispute for a non-received item. Maybe if you use this, it will prompt a response from the seller and you can resolve the issue and get the strike take off.

Yes I have challenged it and raised my own dispute. The seller is not responding to me at all though. I recognise you get bad sellers but what's really annoyed me is that he can even raise a claim when ebay KNOW that I have paid. I have also raised it with Paypal, but he is not responding to them.

As Eric says, it ain't what it used to be. I've had a few poor experiences in the last 6 months or so and notice I'm doing a lot less buying on there than I used to.

Call Ebay customer support on 020 8080 2105 and kick a fuss, they might give you a voucher compensation for the hassle.
All you need to do is send them the email receipt from paypal for the payment you made and they'll reverse the strike.

Wish it was that easy. PayPal refunded a bloke I sold a camera to 4 weeks ago because I refused to refund him after he admitted he'd brought the wrong thing. He then tells PayPal its broke and they refund him without even asking me! I've had no joy getting my £100 back so I'm taking PayPal to court for it. Screw them, not getting away with that!

That's a Paypal dispute, different issue.
Phoning Ebay is to resolve the unpaid item strike the OP got.
To get his money back he needs to speak to Paypal and again it shouldn't be a problem: he can prove he paid and the seller will need to prove the item was signed for if they sent it otherwise they'll have to refund.

It's interesting that everyone says that PayPal side with the buyer - I hope that is the case.

I'm in the middle of a dispute at the moment. To cut it short, bought the item (T-Shirt for my son) on the 9th Feb and still waiting. Raised a dispute a week ago and escalated it yesterday.

Basically the seller has been non-cooperative from the start. He admits that he wasn't able to supply the item because it is discontinued and he even ended the listing early saying 'Item no longer available' - it claimed 9 available of which I bought 1.

But he did not offer refund - guess he thinks he can just keep my money anyway. When he raised the dispute he suddenly claimed that he had sourced the item in Holland and it had been delivered to him. I asked him to send it but after another week escalated because his story just didn't ring true.

I've now had a update from PayPal saying that the seller has provided proof of posting so I'm a little worried that PayPal will side with the seller.

If it turns up then fine but personally I think this is just another of the seller's delaying tactics which he has been using for almost a month now. I'm keeping my eye open for an empty envelope arriving in the mail (for which the seller has proof of posting).

Fingers crossed.

i will never use Paypal again

i paid nearly £400 for an item

the seller asked me to send the money as a Paypal gift to avoid him paying fees

fair enough I THOUGHT

until the item did not work and Paypal told me to get stuffed as i should have paid it directly through Ebay

i thought maybe naively that Paypal covered you regardless?

once bitten - never again

and having lost nearly £400 that seller had better beware

The proof of posting needed would be a recorded delivery tracking number and they enter that into the Paypal dispute which you can also see.

I'm pleased to report that Ebay have now removed the strike against me. But, he shouldn't have been able to raise one in the first place.

I now need to get my money back from Paypal (£60).

I have vowed to never buy anything more than the value of a CD again using ebay, it's just not worth it.

Unfortunately, paypal gift is not supposed to be used for sending payment of goods or services. It is just for gifts. A lot of people are now using it for payment of goods as it attracts no fees, but you do not get any protection at all from Paypal when using this method.

but Paypal make it seem that any payment sent via them is protected?

But that doesn't seem to be true anymore. As far as I can tell, PayPal Gift now attracts fees, the difference is that you can choose whether the sender or the recipient pays them.

This is certainly been the case on the two occasions I used PayPal gift. Perhaps if I had funds in my PayPal account it may have been different but I paid using my Credit Card so had to pay the fees.

In that case there is very little difference between the transactions (normal and gift). Although I'd expect that PayPal would still say the 'Gift' isn't protected even though they have received exactly the same income.

I bought and paid for an item on the 26th Feb but haven't received it yet. When I went into My Ebay, it's says I haven't bought anything for over 90 days.

I then checked my email, and have a confirmation email from the seller confirming payment (as well as a paypal confirmation email). When I clicked on the on the link in the email it brings me to a page that says:
"This listing has been removed or is no longer available. Please make sure you entered the right item number.
If the listing was removed by eBay, consider it cancelled. Note: Listings that have ended more than 90 days ago will no longer appear on eBay".

I've just emailed the seller (who I have used previously with no problems), asking if it has sent.

Sorry for jumping in on this thread, but has anyone had a similar experience?

Probably, mine is linked to my Credit Card - mind you for the sake of losing out on PayPal gift I'd prefer to leave it that way.

I argued with Paypal that certificate of posting doesn't mean it's been recieved and that the buyer can't be out of pocket because of it and they agreed with me on my case a while ago.

The problem I have with that is that I could send you an empty envelope and get a Post Office Certificate of Postage.

I can then claim to have sent you something of value and say that I have proof that I posted it to you.

Recorded Delivery isn't fool-proof but at least it links both ends of the transaction and includes insurance and records the cost of postage and the derived approximate weight of the package.

If PayPal feel that Certificate of Postage is enough I won't be impressed.

Tells you the weight on the reciept, paypal accepted a reciept of me the other week as my proof of postage but they gave the buyer their money back because they were not paypal verified (buyer sent the money to me again), closed my paypal account and wont be opening another one, I also let them know why I closed it.

Not convinced by that. I recently had to return a damaged item to Tesco - they asked me to obtain a Certificate of Posting - I don't recall that it had a weight on it.

Pretty sure that I just have a hand written card with the destination address, the RMA number and the Post Office stamp - that's all.

I'll check when I get home.

I'm sure it does. Just saying that my local Post Office didn't issue me with an electronic receipt (perhaps they can't yet) so I got a card with whatever the teller could be bothered to write on it.

But my package was FreePost so perhaps they can't put that through the till and have to do it manually.

Oh right know what your saying now, don't know if its the same thing but I have sent a few returns back using freepost and was able to get an electronic reciept everytime apart for the last time, last time was being sent to royal mail for a refund about a late special delivery.

When you get wind of a dispute you have to get over to here:-

Resolution Centre - eBay

and respond to what the other party is saying.

I'd log into paypal and check your history, it should have the exact date sent of your payment.
