Return of goods help

Bought a Vita audioR4 online from Peter Tyson. got it today and after taking it out of the box decided I didn't like it (to bulky) I then looked at the terms & conditions for returning goods and find them a little strange. I can only return goods if they are unopened, is this true surley you have to open a item to check if it's ok. I will post the T&C if someone can have a look through them for me before I phone them. the important info is after T&C 9

General

1. Our on-line retail sales operation is aimed at supplying excellent service and value for money.
We don't supply goods on a demonstration basis unless otherwise agreed. If you are not sure about
the product you need we suggest you research it first, before you make a purchase. Because we are an
established retailer with a "real" shop with demonstration facilities, we can offer knowledgeable and accurate advise - please feel free to ask us about anything you are interested in. If you are not sure about a product, we advise you not to buy it until you are.

2. If the size of a product is critical, please make sure it will fit before you make a purchase.
If the dimensions are not shown with the product specification, please contact us and we will provide
you with the full dimensions. Goods that don't fit will clearly have been unpacked and therefore cannot
be returned as "un-opened".

3. All quoted prices include VAT - delivery is extra (unless stated otherwise). Where a price includes
delivery, this is to mainland UK only.

4. On the occasion where a price is listed incorrectly due to a typographical error or otherwise,
we will inform you immediately as to the correct price of the goods. You will then have the option to
proceed with or cancel the sale. A contract isn't active until we have accepted your order.

5. When paying by credit card, goods will be charged to you on the day your goods are despatched.

6. If we cannot supply the agreed goods from stock we will inform you immediately. You can then cancel
the sale or wait an agreed time.

7. Legislation states that the goods must be despatched within 30 days of the sale. Our target is next
day (Saturday not included) unless otherwise agreed and at additional cost to normal delivery.

8. If you are paying by credit card, goods can only be delivered to the address at which your credit card
is registered. Variations may apply, but please ask for details.

9. Deliveries can only be made to addresses with an active landline telephone.

Warranty and repairs

1. In the event of a product failure - you are best advised to speak to us first. Many problems that appear to be faults can be rectified after talking to one of our Staff.

2. Warranty cover is for a minimum of 1 year. Some manufacturers provide a longer term - ask for details.

3. In circumstances where a warranty repair is needed, firstly inform us in either writing, telephone, fax or email. During the first year of warranty we will collect the goods or direct you to a local service centre - which ever is the fastest for you. Your goods will then be returned to you at our expense. Most Web retailers will charge
you for collecting or returning - we do not! Please note that this feature only applies to mainland UK.

4. In the event of a warranty repair in any subsequent years (after the 1st year) we would ask you to send the item back to us. Your goods will then be returned to you at
our expense (UK only).

5. Goods sent back to us or collected as faulty but found to be fully working will be returned to you. Carriage charges will be at your expense. If you suspect a fault, please
contact us first.

6. Goods found to have a fault not covered by warranty (damage or breakage through misuse, incorrect operation, wear and tear etc) will be fixed and returned to you at your expense.

7. We don't operate a re-stocking system, but in the event when after using the goods you find them totally unsuitable, we may consider re-stocking. Contact us if this occurs.

8. Goods must have a returns authorisation number before we can take receipt.

9. Once you have reported your fault, you will be issued with a returns authorisation number.

Right to withdraw

Current legislation gives you the right to cancel the sale from up to 7 working days from receipt of the goods, without penalty and without giving a reason. The following details would have to be complied with:

1. Cancellation to be in writing.
2. The goods must not have been unpacked or used.
3. The goods must not be damaged or soiled in any way.
4. Goods must be in their original packaging.
5. The cost of returning the goods would be at your expense.
6. The goods must arrive back undamaged. Please consider insuring the goods before despatch.
7. A refund would be given only when we have received the goods and the above
points (1 - 4 ) have been complied with.
8. Special orders or customised items can not be returned.
9. Variations to these conditions may apply - subject to mutual agreement.

I have read that info a while back, and found it a touch confusing
I found some other info which was clearer

You can return any non special order item as long as you notify the seller within 7 days either by email or fax and letter and not the phone.

You can take out use the item, but it must be returned in perfect condition with all the packaging.

It does n't matter if the seller does n't completely agree (obviously they won't be over the moon )

It is the law and they must abide with the distance selling rules if they wish to sell this way, as the customer has no real way of knowing the item is exactly what they require.

Consumer direct will help you if you have any problems
