Refund issue at at shop, what is my rights?

Refund issue at at shop, what is my rights?

My wife bought me a watch yesterday, its simply too big for me and I wasnt present when she bought it.

We tried to take it back just now and the retailer refused, saying he only gives exchanges or store credit. I argued that we are entitled to a full refund but he was adamant that we weren't and bascially got very angry.

What is my rights? The watch is undamaged and in box as received with receipt which says"

It is our aim that you are happy with your purcash. If the product bought is not required, please return it within 28 days in its original packaging and condition together with the receipt for an exchange or gift voucher.

This policy doen not appy to products specially ordered to made or size. Our policy is in addition to your statutory rights.

only the goodwill of the retailer will get you a refund , i assume there is nothing else in the shop you like then ???

5th or 6th item down.Because you've just changed your mind,then you could be struggling for a refund,shops discretion only if i've read that correctly.

you have no right by law to a refund. the store doesn't even have to offer the chance to exchange unsuitable goods, that offer is above the legal requirements

depending on what you mean by "too big", they may be able to adjust the strap for you, but if the face is too big or you don't like the look of it then you have the option of keeping it, swapping it or getting a credit note

surely there must be something in the shop you like, or can sell on ebay, or sell the credit note etc. you don't necessarily have to pick another watch

I cant wear watches etc.. i break out into rashes. My wife knows this but thought I could wear it out for a few hours. Sides I cant say i like it all that much either.

The offending watch. Anyone want it? Cheap!

One advantage of buying over the Internet: distance selling rules allows returns to be made, although a restocking fee may apply.

Is it a national jeweler so if you got a credit you could perhaps flog that for more than the watch?

EDIT:

Just a thought, some models of watches are marketed as Hypo-allergenic. Perhaps the jeweler may have some of those?
