car insurance claim?

hi all,
basically someone ran into my car and wrecked the bumper...we exchanged details etc and i contacted my insurers...in order that i dont have to pay excess my insurers are going to pursue for the money via the legal cover i've got.
i got the forms today and have yet to formally apply for the claim....thing is the driver has contacted me saying he would pay for the repairs,keeping the insures out of it...i told him i'd already contacted my insurers and that was that.
....now i'm thinking i could contact him again and see if he still wanted to pay...get the cash sorted then cancel the claim,or is now all too late and i'd severely hack the legal team off as they would now not get a slice of the claim?
could anyone enlighten me?

If i was you i would proceed with the claim.

If you contact your insurers, and tell them that and that you are not prepeared to fork out any money for the repair, this means that you may not have to pay your excess and then have to go down the route of claiming it back via your legal team.

If they get stressy about it, maybe its time to change insurers. they are, after all being paid by you, whatever you decide.

I would suggest that you take that sore neck to the doctors immediately and get a compensation claim in. You'll get £2-3,000 and everything else is covered by his insurance, not yours. I suspect that he may not have insurance and therefore wants to pay you off, but I would still suggest the correct legal route.

I know someone who did what you are suggesting and ended up with the repair bill as the other party never paid up.

Now about that trauma...

only one snag with the sore neck route.....i was sat in the front room at the time!

Report it to your insurance company he might well not be insured however a quick MID (assuming you have the reg) check by your insurers would find out immediately if there was a valid policy. They can do a DVLA trace then to gain the address of the registered keeper.

Often pursing a TP direct who has offered to pay for repairs can be a nightmare however if there's a insurer in the background its a lot easier for your insurers to go to them (with an unsatisfied judgment if needed) and get them to pay as RTA.

He may be geniune and doesnt want to affect his ncd...and he can always settle privately with your insurance company if thats the case.

Anyway its a lot less stressful to use your insurance company (it's what you pay for).

I work for a large Insurance company and the private route is very risky I would always recommend to go through your insuerer.

Are you fully comprehensive? if you are then you can request your insurer to call the third party insuerer to establish liability first then they will waive your excess. The amount of claims I take from people who say the TP(third Party) will pay for the claim private always end in them saying " I didnt cause that much damge" or "your just trying to rip me off" happens all the time. People tend to forget how much accident repairs costs.
You sometimes have to chase your insurance company to get them to sort out the claim but thats just the insurance world for ya.

As metioned above we have access to the MID which we just put the reg in and it comes back with the underwriters of the policy the amount of cars uinsured is pretty high the times I have put a reg in and it comes back with no valid policy is very common. Sometimes the MID is not always 100% accurate as cars maybe insured under a fleet policy so this has to be taken into consideration.

Your Injury claim can be persued through your legal expenses cover if you have been injured.

If anyone wants anyhelp with car claims just let me know Ive done new claims and now Im a claims handler who deals with existing claims.

well i found out i had £500 excess!....thought i had £250 but it was £250 on top of a compulsary £250!.......when i told the guy i had only had one quote so far from the ford garage and told him the figure...he said 'thats not too bad'.....i originally thought he might cough a bit (about £350 worth of repairs)
...thing with the excess is that the insurance company said to avoid the excess charge they'd pursue the money via my legal cover which comes with the policy....thought if the guy was happy to trot round with the money it'll say me a lot of grief as i'm assuming this wont get settled quickly.
....basically it's down to how easy it would be to stop the claim and this early stage before i've submitted any paper work?
....like i say i was'nt even in the car and the guys admitted responsibility and his insurance checks out....it's in his wifes name so i dont think shes too happy.

Excess can be excessive in some cases as if you already have comp x/s and say a vol x/s this is all added together and can mount up.

normally you will find that young drivers are hit hardest especially if they are insured on their parents policys as their x/s is already high due to age. normal excesses can be:

£400.00 under 21
£250.00 21-24

then when you add the vol to that and any comp x/s it goes through the roof.

Legal companies are good at getting your x/s back but still good to see if your insurance comapny can chase the tpi first as could be waived, this process can take time though but if your car is driveable then its a good option.

Couldnt agree more with you on that, amazes me how may people think you can get accident repairs done for under £100.00 or the amount of times I hear T-cut could have got that scratch out.
