any criminal case solicitors?

any criminal case solicitors?

a very close friend is getting worried about a case he has coming up regarding theft/fraud (one or the other not sure which)

hes got a mortgage to look after, 1 kid and past offences to do with dishonesty but nothing over the last 4 years i think.

any guidelines on sentencing/rough idea on what sort of punishment he will receive for a £12k fraud?

is there anything i can do with his mortgage? reduced payments etc due to his circumstance?
i said ill try and look after things for him while hes "away" (and no not his mrs! see i know u guys too well )

a very good freind of mine is a criminal law barrister, so i could ask him for you tomorrow. he may need to know some specifics about the case, il ask him tomorrow and if needs some specifics will drop you a PM.

He'll have some sort of representation . I'd have thought his own legal representative will have a reasonable idea of what sentence he's looking at if he's convicted.

he wants to build up a bigger picture of what to expect.

his lawyer should be able to answer these questions, or citizens advice

if he is put away, his wife might be able to claim tax credits or benefits, housing allowance etc to stop them being turfed out. as there is a kid involved the government would probably step in to help out, particularly if the wife and kid are innocent

he should also have a serious word with his bank/mortgage company. i don't think the bank would be able to throw his wife and kids out easily, at worst the council would probably have to rehouse them first

yeah, someone I know had a guy punch him and when he fought back the guy had a fit and had to be brought back to life. Got sent down for 2 years in Hull!

That's a violent crime though carries tougher sentences. I was potentially looking at GBH with intent a few years back ....maximum sentence life imprisonment.

Seemed a bit harsh at the time considering I was the one that was attacked and the attacker effectively injured himself whilst beating me up....all turned out fine in the end. Huge waste of taxpayers money though.

The guy has got previous.. he clearly did not learn his lesson the first time. I know it sounds harsh, but sorry mate, he deserves everything he gets. I feel sorry for the wife and kid, that is very sad, but his circumstance has been brought on by his own shadey dealings and if the warnings he got before did not scare him into stopping it, then surely a custodial sentence will. First time offence, a custodial sentence is maybe too harsh, but a repeated offender... that's not on.

re: mortgage get him to phone his mortgage company and put the number of years to maximum (35 years I think) that should bring it down enourmously, I did this before when hard times where upon me went from 20 years to 30 nearly 50% off.

he never personally got the money, but thats the amount its cost the company in contracts.
his main concern is family, i know he didnt actually benefit from the fraud, more a case of turning a blind eye to contracts being made with no id etc resulting in fraud.

so get him to up mortgage time 1st. any ideas of maximum sentence using the guidlines that courts work too any solicitors? barristors? judges?

i understand everyones felings on this and im the 1st to moan about silly sentences on violence charges etc.

he allready knows hes gona be punished he just wants an idea of how long hel get or maybe even a custodial sentence may not come into it.
not that it makes a difference but no indevidual has been ripped off, he turned a blind eye to people getting contracts and then a load of them didnt pay there 1st bils resulting in fraud.

to be honest i know he can be trusted despite all this and it was mostly preasure from work and him having to do everything that resulted in this. so much so id ofer him a job working for me.

so i understand all the feedback regards he deserves what he gets etc which is fine but all we all (himself,myself his family our friends) whant to get an idea about is what wil he get?
i know judges work to some guidlines so i thought somebody may know how to work something out using the guidlines

also violence offences:
bloody hell i wont even hit back in a fight now iv got too much to loose.
it seems to be whover gets injured the most and/or makes the complaint 1st gets treated as victim.

id die now if i hit someone back after them attacking me only for me t be sent down somehow for it, the thought of leaving my 2 kids is unbearable!iv never had 1 night since either of them have been born where iv not been there before theyve gone to bed and been there in morning.
i suppose this is the main reason why i feel for my mate as he has 1 child and suppose im connecting with the not seeing the kids side of it more than anything else

Thats not always the case though.
The judge on the day may decide fraud is too prevailiant these days and decides to make an example of him.

Good luck to your m8 krismc, we've all f**ked up at times and some even manage to get away with it.

His wife will have to claim Income Support if she is not working and has a child under 16 years old to look after. She will get Child Tax Credit paid for the child about £43 a week on top of the Child Benefit.

On Income Support she gets £57.45 for herself and seperatly full council tax rebate and she should tell the council tax office if her husband gets sent down as she will get 25% cut from the bill.

The mortgage is tricky. If the mortgage was taken out after October 1995 then she has to wait 39 weeks before income support start paying any interest, if however the mortgage was taken out before Oct 1995 and never re-mortgaged, then she only has to wait eight weeks before getting help with the interest.

She should go to her local CAB for advice.
