Paid Holiday, Sick allowance

Hi

My other half has started a new job at a financial advisors. The hours she'll work aren't the most conventional & what they've told her regarding annual leave & sick pay is a little bemusing to me.

She'll work 26 Hours a week for 39 weeks a year & 10 hours a week during the school holidays - 13 weeks a year.

They have said she will receive 10 Days paid annual leave & absolutely no sick pay.

Is there any general rules regarding these to areas or if anyone has any advice on if this perfectly normal or totally unacceptable?

I'm thinking the days should be nearer 14 & I thought sick pay was mandatory after 16 hours a week (or something).

Any help, comments appreciated.

IIRC sick pay is mandetory after 3 days although its not much, also if sickness occurs again within 8 weeks linked to the original conditon then there is no 3 days waiting
They are probably saying that they will not pay anything or top up the SSP

A lot of financial advisers are effectivly selfemployed, so no need at all for holiday pay, but if not then legally Holiday entitlement is 4 weeks prorata

sick pay is a 'benefit' and not something employers are obliged to pay. At least you know up-front.

My employer pays one week per year - but the year does not start counting until your 'first' April. As a June starter I fell foul of this although it is not stated in the benefit paperwork, apparently (since it refers to SSP) it is implied. Currently £600 down but will see them in small claims court if needs be...

Pro-rated holiday comes to about 14 days, however, I think they're one of these companies that shuts down over christmas so I imagine they'll say the rest of her entitlement is tied into that.

also bare in mind that public holidays can be included in the mandatory 20 days pro rata allowance. so after 8 of those you are may only be entitled to 12 days off.

Think I'll advise her to keep quiet for the time being...

ps. They're paying her a flat salary so although working less hours in August - she'll take home the same pay every month of the year. We both prefer
this option & it would probably make sense to take the 10 days leave outside of the school holidays so she actually works less hours for the same pay.
