sitting tenant ?

Looking for a little legal advice before i contact C.A.B.

I bought a flat from a friend in 1998, he had a member of his family in (his Sisters husband) and they are now divorced.

He only pays rent of £73 per month, the flat is in need of major renovations and would prefer the tenant to leave during the work and to be honest not to return.

He's a scruffy beggar and the flat would be uninhabitable to most decent folk, up until now i have felt kinda sorry for him but he does nothing to help himself.

He is working, i think! for BT so he may be on a decent wage.

There is no tenancy agreement in place and i guess i just inhereted him, any advice before he gets the "big" knock?

Don't even give him a hint of you wanting him out before talking to a LAWYER.
Spend some money on proper legal advice before doing anything,
No more to add but tennancy law on sitting tennants is very watertight.
the rent seems too cheap ,you could try putting it up to market rates but discuss all your aims with the legal bods first.
I doubt the CAB will side with you on this they will be more use at keeping him in!!

Yeah, good advice,thanks.

TBH i havn't been in the flat for 6 years, iv'e had no gas testing done or carried out any repairs as it stinks.

He hasn't complained though, he pays the rent by DD so no contact is needed.

Think i'll have to tread carefully on this one.

slide the gas tester a bung to declare the place unsafe and uninhabitable....he'll have to move out then....heh

on a serious note, if he is paying rent then all you need to do is give him one months notice, if he asks why your kicking him out tell him you are going to do something else with the place.......tbh tho its none of his business why you want him out.......if he wasnt paying rent then he could be more of a problem (ie try to claim rights as a squatter or whatever)...
