Newzbin up in court

Million pound Usenet indexer found guilty • The Register

They've been found guilty of copyright infringement for collating and indexing materials that were already in the public domain without actually storing any copyrighted material.

Serious implications for Usenet indexing sites all round I think.

The full ruling is here.
Twentieth Century Fox Film Corporation & Anor v Newzbin Ltd [2010] EWHC 608 (Ch) (29 March 2010)

Circle the wagons guys, the Indians are coming.

damn. although my regular stuff comes from myTVNZB, I do like newzbin.

I find it odd that they got found guilty. Surely as you say, they only publish reports from 3rd parties indexing content that is already out there?

I have got an account, but I find it virtually useless. </removed> all provide the same content for free!

But yes, very worrying for usenet in general....

Although these companies
(1) TWENTIETH CENTURY FOX FILM CORPORATION
(2) UNIVERSAL CITY STUDIOS PRODUCTIONS LLLP
(3) WARNER BROS. ENTERTAINMENT INC.
(4) PARAMOUNT PICTURES CORPORATION
(5) DISNEY ENTERPRISES, INC.
(6) COLUMBIA PICTURES INDUSTRIES, INC.

had sought a total injunction on Newzbin, it appears the Judge is more likely to order that Newzbin restrict their content and exclude any copyright material owned by the claimants.

It was also reported that the claimants would pursue significant damages at a later date, with one observer commenting it would likely be in the order of the same amount by which the US bailed out their banks.

Bloody hell!

There will be a loophole or a certain section of the site will be removed.

Me too and what's going to happen to the adult version Newzxxx?

Is it against the rules to post alternatives in this thread? I noticed someone had their comment removed? If so I would be grateful if someone could PM me some recommendations.

It's a thin line, some sites can't be posted because they breach our rules by pretty much promoting piracy on their front page... if things like rls group or anything like that are visible or anything that clearly shows pirated material for download it will most likely be removed.

Ahh crap.

The last thing I want to do is start working in an FXP team again.

O well I knew it couldn't last.

Rapidshare...cough.

Premium accounts cost from around £4 per month depending on how many months at a time you pay for. Limited to 5Gb per day but unused bandwidth builds up to a maximum of 25Gb available.

for the Mods....RS don't promote piracy on homepage and have a policy of actively deleting many copyrighted files based on recognised hashes.

Translate the English word "sticky" into Dutch and then find the Dutch web site using the translated word.

Mod comment: Not to be considered a family, copyright or work friendly site

It's worth noting that RS is also flooded with more trojans and keyloggers than your average public torrent site.

Actually I'd say it's no better or worse than any site, public or private. I've seen worse rogue files on some private torrent sites.

Just need to use a bit of common sense

Using a good quality source for the RS links helps.

Oh of course you get dodgy files on other sites, though I would say a private torrent site (a decent one at least) would nuke a bad release within 24 hours. Public torrent sites can be awful - depending on the files, the number of people I know who have ended up with a dodgy crack or such from public torrents is crazy. Though you are right, a good quality source helps, I don't know too much about RS and don't really intend to find out but I didn't know you could find out about the uploader on it?

How do newzbin do that? They already have a take down procedure which is like youtube - i.e if they have a complaint about copyright material they'll take it down. As they don't track the content themselves, how can they know what is copyright or not?

By making the site be responsible for its content, just like here or any other site which is ran properly?

The next hearing in court is mid April. Until then we are required to implement a default policy of blocking movies and TV reports. These will need to be manually authorised by us before they are published. This is cumbersome and, we appreciate, deeply unwelcome. Rest easy that it is temporary and will only last until we can get into court or until we implement a less onerous automatic filter.

I'm surprised they lost to be honest as they dont host anything. The news posts when the trial was on were funny though.

Been a member for 4 years and i will continue to be one until it winds up - which i dont think it will. I've been moving away from it for a little while now though so i'm not sure i'm that bothered really. As for the damages claim i'm sure hollywood will wade in and demand $400 billion. Frankly - i've seen Avatar and I want damages for the emotional trauma i endured and the 8 days it took from my life. (ok it was only 2 and half hours but it felt like 8 days. )

Viva la Newzbin!!!!!

You could apply your argument to torrent sites, they host a link (just in a file) in the same way.

Indeed. However, thats a whole other discussion that (even though you are a mod) I dont think were allowed to have.
