Where do I stand with this returns issue

I am thoroughly ****** off and need a clear head before I start with the telephone calls in order to get this sorted. My wife noticed earlier that the stitching on one of our 5 month old armchairs has come loose along one of the seams (approx 8cm long) she phoned the shop we brought them from and they said they will send someone round on Tuesday to have a look, she said it is very unlikely that it will be fixable but, not to worry, if that is the case, she will give us a refund on the chair.

My problem is I brought 2 as a matching pair.. Having one is no bloody good and I know the manufacturer unfortunately went under 3-4 weeks after we took delivery.

I neither want a single chair in that location or 2 different kinds, we took months and months to find the right style for the room and I am guessing we have no grounds to ask the shop to reimburse us for them both if one is faulty?

Do I have to take this on the chin? Would be a very expensive lesson as they cost far too much

Hi,

There are a few issues at play here, so I'll do my best to explain them in order.

If you bought the chairs with both you (as the customer), and the retailer being that you are buying them "as a pair", then the retailer could well have to agree to refund or replace both chairs. But ONLY if they sold them to you "as a pair".

If, however, you just bought two, because you needed two chairs, then the retailer is only liable to refund, repair or replace the faulty item.

As such, you may have to either:

1) If they will let you, give them back both chairs you currently own, and look for another pair from the same place, for a similar price.

2) Or, simply accept the fact that you will have one chair that will have to be kept by you, or sold on via classified ads, in order for you to go away and buy a new pair of chairs instead.

Personally, I think your options are likely to be:

1) Store will llet you return both, as long as you replace them with another pair to your liking, from them (with items of a similar or higher cash value), or

2) You return just the faulty chair, and end-up having an odd chair in your house!

You may well, have to accept to take this case "on the chin", as the retailer has no legal requirement to refund you for both chairs, unless they knowingly sold them to you on the basis that you were looking for a pair of identical chairs. Sorry.

The other alternative is a repair and maybe be some discount aswell.

I took delivery of a leather sofa that had some small damage on the back. Slightly different because we noticed on the day of deleivery.

The retailer said it wanted to send an assessor round who agreed that there was damage and asked to send an expert repairer round. We agreed on the basis that if we weren't happy we would return both sofas for refund.

The repairer came and did his stuff. If you knew it was there you could see the repair but to be honest since it was on the back no one was ever going to see it. But the independent repairer said "Say that the repairer has done a good job but you can see that a repair has been done. Ask for some compensation". We did that and got £180 back - the two sofas had originally cost us £1,500.
