Help with a problem - trying to get a refund

Help with a problem - trying to get a refund

Anyone know a good place to turn for this?

Basically, I bought 2 tyres from an online retailer, I used paypal to pay. They arranged to deliver them to my local garage who would fit them for me. Unfortunately the garage was just about to close for 3 weeks so I tried to cancel the order.

As the tyres had already been sent they said they couldn't but then I spoke to them on the phone as was told they would call back the shipment and refund my paypal account that day (23 June). Nothing came and I emailed them. I then got an email saying that they would refund that day (25 June). I still have not got a refund.

Now I have raised with paypal as a claim but that takes weeks

Is there anyone I can go to with this email evidence to force them into a refund? It's only for £100 but I have since had to buy tyres from somewhere else so am now £100 down.

Around 14 days in my experience. On what grounds have you raised a claim? Non delivery? Not as described? etc. etc.

Non delivery as they are still lost in transit

Under the distance selling regulations they have to refund any purchases as within 7 days of you receiving them.

If they are messing your around contact www.consumerdirect.gov.uk/
they will give you assistance in writing a letter to request a full refund.

If they ignore this then you can go to https://www.moneyclaim.gov.uk/csmco2/index.jsp and pay £30 which they will also have to pay you or it will go to the small claims court and they will lose as they are in breach of your consumer rights. (You won't need to attend court).

Your posts contradict each other. You first say you changed your mind because the garage you was using was about to close for 3 weeks, then you say you are now claiming non-delivery

All of which is largely irrelevant as you have a 7 working day cooling-off period to cancel an order

They legally have to issue a refund. You can keep contacting them which might spur them on. Whether they act as quickly as you would like is another matter although I now foresee possible difficulties because you have raised a paypal dispute

Whether the goods have in fact been delivered to the consumer and the issuing of a refund are two separate matters and a refund only has to be legally provided within 30 days. Regulation 14

I think you are confusing it with the right of cancellation being available 7 working days after the date of delivery
