Can copyright protection cause this flicker?, this is what Yamaha are telling me it could be!! I find it strange then that receivers offer to convert analogue to digital at all!. Ha s anyone got an oppinion on this?

It may be due to macrovision type copyright protection? I think the issue less important these days because non digital formats and interfaces are becoming scarce now. A simple solution would be to buy a Blu-ray player. The scaling abilities of the BD player will be superior to those of the amp's and you'll be able to use the player's HDMI output.

Thanks Dante01 it was the addition of a blu ray player that prompted the change of amp lol oh well looks like my trusty pioneer 737 has no use now , do you think the Panasonic bdt 320 would upscale better than the reciever?

My experience of the upscaling abilities of AV amps says that such abilities are secondary to the primary purpose of such amps. Unless you've a flagship AV amp then the chances are that your own TV will have equal if not better scaling abilities than an AV amp. When you take into consideration that a quality standalone scaler can cost double the price of most mid range AV amps then you have to question the abilities of a mid range AV amp to scale content. I doubt you'll notice any difference is scaling between your player and the amp? Try it
