Firmware update?

I have just bought an Optiarc NEC AD7170A 18x18 DVD±RW Dual Layer ReWriter and for some reason it will not write to dvd discs i have tried Ritek and TY and they both will not write. Also tried a DL disc and it failed at about 30%. If i were to upgrade the firmware would it void the warranty? It currently has ver 1.02.Or is this drive faulty?

I know it's difficult but you need to test the drive with an assortment of different media. If you still get power calibration errors then i'd take the drive back and get a replacement as flashing another firmware would'nt help in that case.
