Angry Samsung d900 & Vodafone

Hi everybody,

Maybe somebody could advise me on this one

3 weeks ago I purchased with a new 18 mont contract a samsung d900.

I have sent it back already due to problems with the ear piece, vodafone replaced it the next day.

This weekend the phone has just completely given up on me, the screen comes on intially but just looks completely scrambled.

I called Vodafone yesterday to be told that they would send out a refurbished handset (i'm amazed they them already) but wouldn't replace it with a new one as it's been over two weeks.

Can they do this? can i cancel my agreement?

any help would be good as i have had enough.

Also does anyone have a contact name of anybody senior in Vodafone as I want this to go far as it can

thanks everybody

You have a right to 'reject' faulty goods. If you tell the seller promptly that the goods are faulty and you don't want them, you should be able to get your money back. As long as you have not legally 'accepted' the goods you can still 'reject' them – that is, refuse to accept them.

One of the ways you accept goods is by keeping them without clearly saying that you want to return them after you've had a reasonable time to examine them. What is 'reasonable' however is not fixed: it depends on all the circumstances. Normally you can at least take your purchase home and try it out. But if you delay in examining what you've bought or in telling the seller that you wish to reject the goods, then you might lose your right to reject.
Most phone companies give you 28 days for an exchange of a faulty phone, you'd have to check with Vodafone for their policies. Should be with your documentation?
