Advice please :faulty MotorolaV547 from O2 5 weeks old.

Hi ,I bought the Motorola V54728th October from O" online for my wife. Since receiving it we have just found it has been ringing numbers randomly from it`s phone book without any prompting from anyone.I didn`y beleive it until 20 mins ago.we were waiting for a cal lon the landline from my daughter ,when it rang.there was noonne at the other end. She put the landline back on the coffee table,when it rang again .same agian no one there.Ah!! I thought could this be the mobile calling without promting. (We had several complaints about the mobile calling my son ,her friends previously. She couldn`t understand it sa she certainlky hadn`t called them.0 So we rang 1471 and recalled the previous caller on the landline.Yep!! the mobile rand.It was the mobile that had called previously. i must add that whilst it was calling it was sat on the coffeee table beside my wife with no one touching it. Don`t ask me how it does it ,but it does.
his confirmed previous suspicions ,so I called O2 customer services,who told me to return it with a returns lable .she said I should ring the returns number to obtain a lable .On ringing that number after giving all relevantinfo I was told because I had had the phone longer than 4 weeks Ihad to take it to a O2 retail shop for repair. When I asked why ,I was told this is O2 policy.
Can anyone confirm this is what I should do or are O2 obliged to exchange or refund as it sounds like an inherrant fault.

if i am not mistaken if its over 4 weeks you do have to have it repaired. have you asked about compenstaion for the use of minutes when calling randomly?
