Pirates of the Car' incorrect EX/ES flag???

Does anyone have the definitive answer?
On the dolby site it is not listed as an EX soundtrack and on the disc packaging and menu's it is listed as DD/DTS5.1 yet it forces my Tag into EX/ES.
Is this an incorrect flag a la' Pearl harbour???

The film was released in theaters with Dolby Digital Surround EX and it shows the logo in the credits. When I play the dvd on my set the EX indicator lights up so I assume that it is correctly flagged.

I will check end credits when i get the chance, i have but only had it on for a moment or two. Thought the colour palette was very vibrant though.
Even the mighty Dvdfile have it listed as 5.1 only.
