Ok guys I have not heard from Amazon so have contacted Consumer Direct and they have told me that I do have a case and this is the letter to send to them (amazon)

making it out to cover my problem.
Suggest you all try the same thing (with your sellers) as the seller has a responsibility to sell a product that should be of good quality and not inherently faulty as our cameras seem to be.
